Terms of Use
These terms are an agreement between you and Luis Alarcon ("we", "us"), the developer of the Plan by Phase iPhone app (the "App"). By downloading or using the App you agree to them. Apple's Standard License Agreement (the standard Licensed Application End User License Agreement) applies to the App, and these terms add to it.
1. What the App is, and is not
Plan by Phase is a lifestyle planner. It estimates cycle phases from the dates you enter using a simple calendar model and suggests how to plan workouts, work, social plans and skincare around them. The phase labels and do / skip lines are general wellness suggestions based on group research about how energy, mood and sleep tend to shift across a cycle.
The App is not a medical device, does not provide medical advice, and does not diagnose, treat, predict or prevent any condition, pregnancy, or fertility outcome. Do not use it for contraception or conception planning. Always talk to a licensed clinician about menstrual health, symptoms or fertility. If you use hormonal contraception, the phase model may not describe your body.
2. Subscriptions
Access to the App is sold as an auto-renewing subscription through the App Store. There is no free tier. Current options:
- Weekly — US $6.99 per week, renews every week.
- Monthly — US $12.99 per month, renews every month.
- Yearly — US $39.99 per year, renews every year.
The exact price in your currency is shown in the App before you confirm. Payment is charged to your Apple ID when you confirm the purchase. The subscription renews automatically at the same price and period unless you cancel at least 24 hours before the end of the current period. You can manage or cancel it at any time in iOS Settings → your Apple ID → Subscriptions. Cancelling stops future renewals; the current period stays active until it ends. Apple's refund policy applies to all purchases; request refunds at reportaproblem.apple.com.
Prices may change for new subscription periods. If a price increase requires your consent under App Store rules, Apple will ask you before it takes effect.
3. Restoring purchases
If you reinstall the App or switch iPhones, tap Restore Purchases in the App. Access is tied to your Apple ID, not to a Plan by Phase account (there is none).
4. Your content and data
Your cycle inputs stay on your device and are covered by the Privacy Policy. You are responsible for keeping your device secure. Because we do not hold copies, we cannot recover your data if you delete the App or lose the device.
5. Acceptable use
- Use the App only for personal, non-commercial planning.
- Do not reverse-engineer, scrape, resell, or use the App to provide clinical or coaching services to others.
- Do not use the App in a way that violates any law or Apple's App Store terms.
6. Intellectual property
The App, its design, copy, recommendation catalog and the "Plan by Phase" name are ours or licensed to us. We grant you a personal, revocable, non-transferable licence to use the App on Apple devices you own or control, as permitted by the App Store terms.
7. Disclaimers
The App is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including fitness for a particular purpose. Phase estimates are approximations; cycles vary, and the App can be wrong about where you are in yours.
8. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim relating to the App is limited to the amount you paid for the App in the twelve months before the claim. We are not liable for indirect, incidental or consequential damages. Some jurisdictions do not allow these limits, in which case they apply to the extent permitted.
9. Termination
You may stop using the App and cancel your subscription at any time. We may suspend or end access if you breach these terms. Sections 4 to 11 survive termination.
10. Changes
We may update these terms. We will change the last-updated date above and, for material changes, show a notice in the App. Continued use after the notice means you accept the new terms.
11. Governing law and disputes
These terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules. Before filing a claim, please email us and give us 30 days to resolve it. Nothing in these terms limits consumer rights you have under the law of your place of residence.
